Terms of Use

Nocala Terms of Use

Effective date: 9 October 2026
Last updated: 9 October 2026

These Terms of Use (“Terms”) govern your use of the Nocala iOS app and related services (the “App”). By downloading, installing or using the App you agree to them. If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years old and able to enter into a binding contract to use the App. If the law of your country sets a higher age, that age applies.

2. What Nocala is, and what it is not

Nocala helps you organize the evening runway toward sleep, optionally shield apps you choose, optionally support waking, and review your mornings. It is a behavior-support tool.

  • Not medical advice. Nocala does not diagnose, treat, cure or prevent any condition, including insomnia, ADHD or nocturia. Its guidance (for example on caffeine, meals, light, showers, screens and phone placement) is an adjustable starting point, not medical certainty. If you have concerns about your sleep or health, consult a qualified professional.
  • Drinking. Hydration guidance is about timing larger drinks. You may drink when you are thirsty. Never restrict fluids in a way that harms you.
  • You stay in control. The App suggests; you decide. Nothing is scheduled as an alarm, notification or shield without your approval.

3. Screen Time, shields, alarms and notifications

  • Shields are not unbypassable. Nocala uses Apple’s Screen Time frameworks to shield apps, categories and websites that you choose. You can revoke Screen Time authorization, change the selection, or end a shield at any time, in the App or in iOS Settings. Nocala does not claim to be impossible to bypass.
  • Essential functions. Nocala is not intended to block essential phone functions such as emergency calls. Do not rely on Nocala for that purpose.
  • Alarms and reminders are not guaranteed. Wake-up Support and notifications depend on your device, iOS version, battery, settings, Focus modes, permissions and Apple’s systems. They can fail or be revoked. Do not rely on Nocala as your only alarm for anything critical, such as travel, medication or work obligations.
  • Privacy of selection. Nocala does not read or transmit the identities of the apps you select; see the Privacy Policy.

4. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms (including Family Sharing where applicable). You may not:

  • copy, modify, translate or create derivative works of the App;
  • reverse engineer, decompile or extract source code, except where mandatory law allows it;
  • remove proprietary notices;
  • use the App unlawfully or to interfere with its operation or with Apple’s services;
  • rent, sell, sublicense or otherwise commercially exploit the App.

5. Nocala subscription

Nocala requires an active paid entitlement before onboarding can be completed. There is no freemium core. The available paid options may include:

  • a monthly subscription,
  • an annual subscription, and
  • a lifetime one-time purchase.

Which options are offered can change over time. The price, duration and any free trial are shown in the App Store purchase sheet or the in-app offer before you buy.

Payment. Purchases are charged to your Apple Account at confirmation of purchase. We do not receive your payment details.

Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. Manage or cancel in iOS Settings -> your name -> Subscriptions. Deleting the App does not cancel a subscription.

Free trials. If a free trial is offered, any unused part is forfeited when you purchase a subscription. Cancel at least 24 hours before the trial ends to avoid being charged.

Lifetime. “Lifetime” means a one-time purchase that unlocks the Pro features for as long as we offer Pro in the App. It does not mean your lifetime or a guarantee of any specific feature. If we ever discontinue Pro, we will give reasonable notice and, where the law requires it, a refund or other remedy.

Restore. You can restore purchases in the App on any device signed in to the same Apple Account.

Refunds and withdrawal. Apple is responsible for payment and refunds. Request refunds at https://reportaproblem.apple.com. If you are a consumer in the EU, you may have a statutory right to withdraw from a digital purchase within 14 days, which is exercised through Apple’s process. By purchasing and starting to use Pro immediately you acknowledge that, where the law allows, you lose the right of withdrawal once the digital content has been provided with your agreement.

Price changes. Prices may change. Apple will notify you and, where required, ask for your consent before a subscription price increase takes effect.

6. Garden and virtual items

The garden and any rewards are decorative, virtual and have no monetary value. A missed, incomplete or unverified night never removes previous garden progress. We may adjust visuals and mechanics as the App evolves.

7. Your responsibilities

You agree to use the App lawfully, keep your device and iOS reasonably up to date, and grant only the permissions you want to grant. You are responsible for your own sleep, schedule and decisions.

8. Intellectual property

The App, its design, text, artwork and code belong to us or our licensors and are protected by copyright and other laws. The App includes open-source and third-party components that are subject to their own licences. Except for the licence in Section 4, no rights are transferred to you.

If you send us feedback, you allow us to use it to improve the App without obligation to you.

9. Third-party services

The App relies on Apple services (App Store, Screen Time, AlarmKit, notifications) and on third-party providers described in the Privacy Policy (including Superwall and Amplitude). Their terms apply to your use of those services. We are not responsible for them.

10. Changes, availability and termination

We may update or discontinue the App or any feature, for example to keep it working with new iOS versions or for security or legal reasons. We will give reasonable notice of changes that materially reduce what you paid for.

You may stop using the App at any time by deleting it. We may suspend or end your licence if you materially breach these Terms.

11. Warranty and liability

Your statutory rights. If you are a consumer, you have legal rights if digital content or a digital service does not conform to the contract (for example under Directive (EU) 2019/770 and Polish consumer law). These Terms do not limit those rights.

Otherwise, the App is provided “as is” and “as available” to the extent permitted by law, without promise that it will be uninterrupted, error-free or that it will improve your sleep.

Limit of liability. To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by alarms, notifications or shields not working as expected. Our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability for intentional misconduct or gross negligence, for death or personal injury caused by our fault, or for anything that cannot be limited by law.

12. Apple terms

If you use the App on an Apple device, you acknowledge and agree that:

  1. These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.
  2. Our licence to you is limited to a non-transferable licence to use the App on Apple devices you own or control, subject to the Usage Rules in the Apple Media Services Terms.
  3. Apple has no obligation to provide maintenance or support for the App. Contact us at hello@nocala.app.
  4. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
  5. We, not Apple, are responsible for any claims about the App, including product liability, legal or regulatory compliance, and consumer protection claims.
  6. If a third party claims that the App infringes their intellectual property rights, we, not Apple, are responsible for investigating and defending that claim.
  7. You represent that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and are not on any US government list of prohibited or restricted parties.
  8. You must comply with applicable third-party terms (for example your wireless carrier agreement) when using the App.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.

13. Governing law and disputes

These Terms are governed by Polish law. If you are a consumer, you also keep the mandatory consumer protections of the country where you live, and you may bring proceedings in the courts of that country. Other disputes are subject to the courts competent for Poland. Out-of-court options for consumers in Poland include the municipal or county consumer ombudsman and the Provincial Inspectorate of Trade Inspection. We are not obliged to use alternative dispute resolution, but we are happy to try to resolve your issue first: write to hello@nocala.app.

14. Changes to these Terms

We may update these Terms. We will tell you about material changes in the App or on https://nocala.app at least 30 days before they apply. If you do not agree, stop using the App before the change takes effect; if you continue to use it afterwards, the new Terms apply, subject to your statutory rights.

15. General

If any provision is found invalid, the rest remains in force. These Terms and the Privacy Policy are the entire agreement between you and us about the App. Our failure to enforce a provision is not a waiver. We may assign these Terms to a successor of the App; you may not assign them without our consent.
